It can be particularly difficult to manage the emotions involved when a loved one's life was ended due to accident or negligence. Although nothing can truly compensate for the loss, it is possible for the survivors and beneficiaries to bring suit against the individuals or companies that caused the death. If this suit ends successfully, the survivors are awarded compensation that takes into account the sorrow, mental anguish, lost income and loss of companionship.
The compensation in terms of damages can often be difficult or even impossible to calculate. The amount can be very high, and many wrongful death lawsuits result in substantial monetary awards to the survivors.
Who are the survivors that have a right to be compensated for a Wrongful Death?
The laws of each state vary in identifying the persons entitled to compensation for a wrongful death. Usually, the list of survivors includes the spouse and children of the lost loved one. Sometimes the definition of “children” includes persons who are over the age of 18. Some states also extend the entitled individuals to grandparents, legal dependents, or members of the extended family.
